This is an English translation of our Turkish Terms of Use, provided for your convenience. In the event of any discrepancy between the two versions, the Turkish original prevails.

1. Description of the Service and Acceptance

These terms of use govern the use of the Perlecta mobile application provided by Dedeyunus Keskin (sole proprietor; "Perlecta", "we"). Perlecta is a mobile application that converts photographs of paper or digital documents into tables or text using AI-assisted OCR (optical character recognition) technology. Alongside this main function, and depending on your plan, the following additional tools are offered: file format conversion (§3.1), invoice recognition, table generation, translation, document summary, saving to Google Drive, and voice-to-text input. Which tool is included in which plan is shown, kept up to date, on the plan screen inside the app; some tools are available only in paid plans. By downloading the app, creating an account or using it, you are deemed to have accepted these terms. If you do not accept the terms, you must not use the application.

3. Subscriptions, Automatic Renewal and Cancellation

Perlecta offers a free initial use (one-off introductory scans followed by a time-limited daily entitlement — see "Free Use" below) together with paid subscription plans that carry a monthly or annual quota. Which plans are on sale and what they contain is shown, kept up to date, on the plan screen inside the app — these terms do not undertake that any particular plan is on sale. A plan marked "under construction" in the app means it is not yet being sold, and we make no commitment whatsoever regarding that plan.

3.1 File Format Conversion and Fair Use Limits

In addition to scanning, Perlecta also offers a file conversion tool (Word→PDF, Excel→PDF, PDF→Word, PDF→Excel). This tool is free in all plans, but it is not unlimited, because every conversion consumes real processing power on the server. The limits in force are:

File size: Free 5 MB · Starter 10 MB · Pro and Ultra 20 MB
Per minute: Free 1 file · Starter 5 · Pro and Ultra 10
Per day: Free 5 files · Starter 30 · Pro 100 · Ultra 300
System-wide: At most 3 conversions are processed at the same time; at times of heavy load your request is politely declined and you are asked to try again shortly.

4. Refunds and Credit Refunds

4.1 Your Right to Cancel (EU/EEA, UK and Gibraltar consumers)

If you are a consumer in the European Union or the European Economic Area (including Germany, Austria, Luxembourg and Liechtenstein), the United Kingdom or Gibraltar, you have a statutory right to withdraw from the purchase within 14 days of making it. A Perlecta subscription is a digital service, and the app store states that for digital services this right applies and that you may cancel within 14 days for a full refund.

Where to exercise it: your purchase contract is made with the app store, not directly with us — the store is the seller and processes all payments. You therefore exercise this right through the store, using its own withdrawal form or refund flow: Google Play — refunds in the UK and EEA. If you have difficulty, write to us at info@perlecta.com and we will help you follow it up.

Nothing in these terms removes or limits this statutory right. This clause describes where to use it; it does not replace it.

5. Third-Party Dependencies and the Right to Change Prices/Quotas

Perlecta's core function, the OCR service, depends on the infrastructure of third-party AI providers (Google Gemini, Mistral AI; on the Ultra plan also Microsoft Azure and OpenAI). Therefore:

6. Accuracy of the Service and Limits of Responsibility

Perlecta is designed to transfer the text and tables in your document into digital form as they are, honestly and faithfully. The application shows you the reading confidence level for each cell (certain, uncertain, unreadable) and offers a "Confirm and Save" step before saving; these tools reduce risk, they do not eliminate it.

11. Force Majeure and Continuity of Service

Perlecta's service depends on third-party AI providers, on internet infrastructure and on mobile app stores. Perlecta cannot be held responsible for interruptions arising from earthquake, fire, power or internet outage, provider failure or shutdown, measures taken by official authorities, or similar events beyond our reasonable control; in such cases we will make reasonable efforts to restore the service as soon as possible. It is not guaranteed that the application will operate without interruption or error; for scans that cannot be processed because of an interruption, a credit refund is made under §4.

Technical support is provided only through official communication channels (info@perlecta.com, and "Report a Problem" inside the app).

13. Limitation of Liability

Consumers in Germany, Austria, Switzerland, Liechtenstein and Luxembourg. Nothing in these Terms excludes or limits the mandatory rights you have as a consumer under the law of the country where you live — in particular your rights in respect of digital products. Our liability for intent and gross negligence, for injury to life, body or health, for breach of essential contractual obligations and under product liability law remains unaffected.

Consumers in Australia and New Zealand. Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or the Consumer Guarantees Act 1993 (NZ) that cannot lawfully be excluded.

Consumers in Ireland, Malta, Gibraltar, Jersey, Guernsey and the Isle of Man. Nothing in these Terms excludes or limits the statutory rights you have for digital content and digital services under the law of the place where you live — including the Consumer Rights Act 2022 (Ireland), the Consumer Affairs Act (Cap. 378, Malta), the Supply of Goods and Services (Jersey) Law 2009 and the Trading Standards (Fair Trading) (Guernsey) Ordinance 2023.

To the fullest extent permitted by applicable mandatory consumer legislation, Perlecta is not liable for direct, indirect, incidental or consequential damages arising from the use of, or the inability to use, the application. In any event, Perlecta's total liability cannot exceed the amount you paid us for the subscription period (monthly or annual) that is the subject of the dispute.

What is never excluded. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, this paragraph prevails over anything else in this section.

14. Governing Law and Dispute Resolution

These terms of use are governed by the laws of the Republic of Türkiye. In disputes between us and commercial or corporate users, the Courts and Enforcement Offices of Kayseri have jurisdiction. Users who qualify as consumers always retain the right to apply to the Consumer Arbitration Committee or the Consumer Court at their own place of residence under the applicable legislation (Law No. 6502 on Consumer Protection); this article does not restrict that right.

Consumers outside Türkiye. If you are a consumer habitually resident in another country — for example in the Germany, Austria, Switzerland, Liechtenstein, Luxembourg, the United Kingdom, Ireland, Australia or New Zealand — choosing Turkish law does not deprive you of the protection of the mandatory consumer rules of your own country. Those protections continue to apply to you, and you may bring proceedings in the courts of the country where you live.

If any of these terms is held invalid, this does not affect the validity of the remaining articles; the invalid article is reinterpreted in the way closest to its purpose.
